Welcome to Camaleonic Analytics ("we", "our", "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, app, and services (collectively, the “Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Summary

By using Camaleonic Analytics, you agree to follow our rules, allow us to analyze your social media data to provide insights, and respect our intellectual property. You are responsible for your content’s legality, account security, and all activity under your account. We protect your privacy and data, but we are not liable for issues caused by third-party platforms or inaccurate data. Payments for subscriptions are non-refundable, and late payments may incur fees or account suspension. Please read the full Terms below for details.

1. Overview of Our Services

Camaleonic Analytics provides tools to connect your social media accounts or upload content, analyze engagement and performance metrics, and estimate the economic value of your posts, stories, and other media. The data and insights are displayed in dashboards for personal, business, or agency use.

2. Eligibility

To use the Platform, you must:
  • Be at least 18 years old.
  • Have the legal capacity to enter into a binding agreement.
  • Use the Platform in compliance with applicable laws and these Terms.
If you are using the Platform on behalf of an organization or business, you confirm you have the authority to bind that entity to these Terms.

3. Account Creation and Credentials

3.1 Registration

To access the Platform, you must register with unique credentials (e.g., username and password). You agree to provide accurate and complete information during registration and to keep this information updated.

3.2 Responsibility for Account Activity

You are fully responsible for all activities under your account. You must immediately notify us at team@camaleonicanalytics.com if you suspect unauthorized access to or use of your account. We are not liable for any losses or damages resulting from unauthorized use if caused by your failure to secure your credentials.

4. User Content and Data

4.1 Ownership

You retain all rights to the content (e.g., social media data, images, videos, metrics) you provide or connect through our Platform (“User Content”). By using our services, you give Camaleonic Analytics permission to use and analyze your content to provide our services. This permission is limited, can be canceled by you, and we do not charge for it.

4.2 Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. You confirm that you have all necessary rights and permissions to provide us access to this content, including any consents from third parties (e.g., for shared posts or images).

5. Use of the Platform

You agree not to:
  • Use the Platform for illegal activities, such as violating intellectual property or privacy laws.
  • Attempt to hack, disrupt, or gain unauthorized access to the Platform or its data.
  • Use our tools to generate misleading or fraudulent analytics reports.
  • Share your login credentials with others or allow unauthorized access to your account.
  • Use the Platform to build competing services or products.
We may suspend or terminate accounts that violate these rules without prior notice.

6. Privacy and Data Protection

We respect your privacy. Please review our Privacy Policy to understand how we collect, use, store, and protect your information.
Camaleonic Analytics may collect metadata, engagement data, and performance statistics from connected social media accounts. We do not sell your data to third parties.

6.1 Data Retention and Deletion

We retain your User Content and associated data only for as long as necessary to provide the services or comply with legal obligations. Upon account termination, we will delete your data within 30 days, except where required by law. You may request data deletion by contacting us at team@camaleonicanalytics.com.

6.2 Data Security

We implement industry-standard security protocols, comparable to those used by leading analytics platforms to protect your data. 7. Confidentiality

Both you and Camaleonic Analytics agree to protect confidential information shared through the Platform, including proprietary data, analytics reports, and business information. You may not disclose our confidential information to third parties without our written consent, except as required by law. Similarly, we will protect your confidential User Content and not disclose it except as necessary to provide our services or comply with legal obligations.

8. Software License and Restrictions

8.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for internal, non-commercial purposes only, subject to these Terms.

8.2 Restrictions

You agree not to:
  • Copy, modify, distribute, or reverse engineer any part of the Platform, including its software, algorithms, or analytics tools.
  • Use the Platform to develop or operate competing services or products.
  • Remove, alter, or obscure any Camaleonic Analytics branding, trademarks, or copyright notices.
  • Share, sell, or distribute our software or services without our written permission.
All reports and data exports generated through the Platform must retain Camaleonic Analytics branding, including logos and attribution, as specified in our guidelines.

9. Paid Services

9.1 Billing and Payments

Monthly or annual subscription fees are billed automatically in advance and are non-refundable, except as outlined in our refund policy (available at https://camaleonicanalytics.com/refunds). We accept payments via credit card, PayPal, or other methods specified at checkout. Subscriptions auto-renew unless canceled at least 24 hours before the renewal date through your account settings.

9.2 Late Payments

Late payments will incur a 3.5% monthly fee, calculated from the due date. If payment remains outstanding for 60 days, we may suspend your account until all dues are cleared.

9.3 Account Reinstatement and Data Deletion

To reinstate a suspended account, you must clear all outstanding dues. If an account remains lapsed or unpaid, we may delete your account and associated data after 60 days of non-payment. Retroactive analysis or reactivation of expired accounts may incur additional charges, as specified at the time of request.

9.4 Changes to Pricing

We may update pricing or features with 30 days’ notice via email or in-app notification. Your continued use of paid services after such changes indicates your acceptance of the updated terms.

10. Disclaimers

10.1 No Guarantee of Results

We provide estimates and insights based on available data, algorithms, and models. These are informational only and do not guarantee actual performance, earnings, or market value.

10.2 Third-Party Platforms

Our services integrate with third-party platforms (e.g., Meta Platforms, TikTok, YouTube). We are not responsible for changes in their APIs, policies, access restrictions, data inaccuracies, or service interruptions that may affect our Platform’s functionality or the accuracy of our analytics.

11. Limitation of Liability

To the maximum extent permitted by law, Camaleonic Analytics is not liable for:
  • Any loss of data, revenue, profits, or business resulting from your use of the Platform.
  • Any errors, delays, or inaccuracies in our analysis or dashboard output.
  • Any unauthorized access to your account or data caused by your actions.
Our total liability in connection with the Platform shall not exceed the amount paid by you (if any) in the past 12 months.

12. Account Suspension or Termination

We may suspend or terminate your access if you:
  • Breach these Terms,
  • Engage in fraudulent, abusive, or illegal behavior,
  • Violate the rights of other users or third parties,
  • Fail to pay subscription fees as outlined in Section 9.
You may terminate your account at any time by contacting us at team@camaleonicanalytics.com. Upon termination, your data will be handled as outlined in Section 6.1.

13. Changes to the Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised “Effective Date.” For significant changes, we will notify you via email or in-app notice at least 14 days before they take effect. Your continued use of the Platform after changes indicates your acceptance of the updated Terms.

14. Governing Law and Jurisdiction

14.1 Governing Law

These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain, unless otherwise required by applicable law.

14.2 International Users

If you access the Platform from outside Spain, you are responsible for complying with applicable local laws. We make reasonable efforts to comply with international data protection regulations, such as GDPR for EU users.

14.3 Dispute Resolution

For EU users, you may have the right to resolve disputes through the EU’s Online Dispute Resolution platform. We encourage you to contact us first at team@camaleonicanalytics.com to resolve any issues amicably.

15. Force Majeure

Camaleonic Analytics is not liable for delays or failures in providing services due to events beyond our reasonable control, including but not limited to natural disasters, internet outages, or third-party platform failures.
